Please read these terms carefully before using NomosPay. By installing or using the App you agree to be bound by these terms.
These Terms of Service ("Terms") constitute a legally binding agreement between mydeveloper.ma ("Provider", "we", "us") and the law firm, legal professional, or other entity ("Customer", "you") that installs, accesses, or uses the NomosPay application ("App", "Service").
By clicking "Add to Workspace", installing the App via the monday.com Marketplace, or otherwise accessing or using the Service, you represent that:
If you do not agree to these Terms, do not install or use the Service.
NomosPay is a monday.com embedded application that provides the following core capabilities to law firms and legal professionals:
The Service requires an active monday.com workspace subscription. The Provider does not guarantee compatibility with all monday.com plan tiers; refer to the monday.com Marketplace listing for current compatibility information.
The Provider reserves the right to modify, update, or discontinue features of the Service with reasonable notice.
NomosPay is offered in four subscription tiers: Free, Starter, Pro, and Firm. Feature availability per tier is described at index.html#pricing and on the monday.com Marketplace listing. The Provider may adjust tier features with 30 days' notice.
Paid subscriptions are billed monthly or annually through the monday.com Marketplace billing system. You authorize monday.com to charge your payment method on file. All fees are in US Dollars unless otherwise stated. Applicable taxes are added as required by law.
Subscriptions auto-renew at the end of each billing period unless cancelled. You may cancel at any time from your monday.com account billing settings. Cancellation takes effect at the end of the current paid period; the App continues to operate in paid mode until that date.
Paid plans (Starter, Pro, Firm) include a 14-day free trial. No payment method is required to start the trial. At the end of the trial, the account automatically downgrades to the Free plan if no payment method is on file.
Monthly subscription fees are non-refundable except where required by applicable law. Annual subscriptions may be refunded on a pro-rata basis for unused months if cancellation is requested within 30 days of the annual renewal date. To request a refund, contact support@mydeveloper.ma.
The Provider may adjust subscription prices with 30 days' advance notice delivered via in-app notification or email to the workspace administrator. Continued use of the Service after the effective date of a price change constitutes acceptance of the new price.
The Service is designed and licensed for use by law firms, in-house legal departments, legal aid organizations, barristers' chambers, and other legal service providers. Use by non-legal entities is permitted but the Service is not optimized for non-legal billing workflows.
You agree not to:
Violation of these restrictions may result in immediate suspension or termination of access to the Service without refund.
The NomosPay application, its source code, user interface design, documentation, branding, and the "§ NomosPay" trademark are the exclusive intellectual property of mydeveloper.ma. These Terms do not transfer any ownership rights to you. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service during your active subscription period.
The Uniform Task-Based Management System (UTBMS) task, activity, and expense codes (L-series, A-series, E-series) are an open public standard maintained by the ABA Legal Technology Resource Center and ACCA (now ACC). They are not proprietary to NomosPay. Their inclusion in the App does not create any IP claim by mydeveloper.ma over the UTBMS taxonomy.
You retain full ownership of all billing data, time entries, invoices, and trust records you create using the Service. By using the Service, you grant the Provider a limited, non-exclusive license to process your data solely as necessary to provide the Service features described in §2.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
In summary: NomosPay stores all data exclusively via the monday.com Storage API within your monday.com workspace. The Provider does not operate an external database or transmit your billing data to any third party. All data is deleted immediately upon uninstall. See the Privacy Policy for full details.
You are responsible for ensuring that your use of the Service complies with applicable data protection laws (including GDPR if applicable) with respect to any personal data of your clients or employees that you enter into the App.
The trust and IOLTA ledger features in NomosPay are billing record tools designed to help you track client funds associated with billable matters. They are not a certified or bar-approved trust accounting system and do not replace your obligation to maintain compliant trust accounts using software that meets your state bar's specific requirements.
If you are unsure whether NomosPay's trust ledger features meet your jurisdiction's trust accounting requirements, consult your state or provincial bar association, a legal ethics counsel, or your malpractice insurance carrier before relying on them.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, the Provider's liability is limited to the maximum extent permitted by law.
These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Casablanca Commercial Court (Tribunal de Commerce de Casablanca), Kingdom of Morocco.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
If you are a consumer located in the European Union, you retain any mandatory consumer protection rights afforded by the law of your country of residence that cannot be waived by contract.
The Provider may modify these Terms at any time. Material changes will be communicated to workspace administrators via an in-app notification and/or email at least 14 days before the updated Terms take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date and may request a pro-rata refund for any prepaid unused subscription period.
